Hugh of Saint-Victor's De Sacramentis is usually regarded as an early summa of theology. As such it has been regarded as not totally satisfying, lacking a clearness of its conceptual system when compared with the work of e.g. Peter the Lombard. What may make up for this lack of system and even confer coherence, be it on a different level, is Hugh's pedagogical view of creation and salvation history, as it shows most clearly in his tropological digressions. In his exposition (...) of the history of salvation as it unfolds since the very beginning, Hugh incorporates the process by which the monk can not only follow the story of the macrocosm, but at the same time can read his self into being, allowing recognition of ambivalence from the start, and thus presenting a multi-demensional view of being human. In the same way as, on the cosmic level, any pre-lapsarian state of innocence exhibits a flaw from the very beginning, so the life of man is in a permanent state of ambiguity. This ambiguity is the framework for man as a moral being. Only within the possibility of choice can man be just or happy, without choice justus and beatus have no real significance. Matters are shown to be even more complicated when, in the story of Eve Hugh draws attention to her doubtful interpretation of God's command, as a factor which precedes her choice. In this way, De Sacramentis is not only a doctrina in our sense of the content of Christian dogma, but it offers the monk a point to which he can attach and conform his intentio: by bringing his intentio in form with the story about creation and fall and reparation, the reader can in fact effect the necessary reparatio, consisting of knowledge of truth and love of virtue. My chief object in these notes is to provide evidence for tracing the ancestry of certain themes, situations, and characters which appear in New Comedy; I hope, however, that they may also be useful for the study of Middle Comedy itself. I am therefore chiefly concerned with the period from 400 b.c. to 320 b.c., when Menander had begun to write; I have, however, given some dates after 320 which were necessary to complete my story, but I have left out (...) many plays by poets of New Comedy which can be dated in the decade 320–310 b.c. I have also omitted the originals of Plautus Amphitruo, Persa, and Menaechmi, although I am convinced that they all belong to Middle Comedy and hope to consider the problem more fully elsewhere; the tactics of the battle in the Amphitruo are possible for Epameinondas and Philip as well as for Alexander, but the clash of two kings seems to limit the reference to Alexander and Dareios as depicted in the famous mosaic, and the limits are 330–320 ; the original of the Persa must have been written before Alexander's conquests and the limits seem to be 345–338; Hueffher's late dating of the original of the Menaechmi has been successfully countered by Fraenkel and the whole feel of the play suggests Middle rather than New Comedy. The following list is arranged in decades, except where it has proved necessary to use a longer period. I have tabulated first the plays or victories dated by inscriptional or other firm evidence; among these I have included the plays dated by Geissler, without comment except where I disagree with him. The Bellum Hispaniense, often considered alongside the two other pseudo-Caesarian commentarii, the Bellum Alexandrinum and the Bellum Africum, contains the account of Caesar's final battles with Pompey's forces in Spain during 46 and 45 b.c. In terms of its language and style, the BHisp. is certainly the most un-Caesarian of the pseudo-Caesarian Bella. The work abounds in phenomena belonging to different linguistic varieties, and is an important piece of evidence in the process of the standardization of written Latin.

Although the declaratory theory is arguably a central feature of common law adjudication, it is widely disparaged: either the law never changes, which is implausible, or it is changed retrospectively, which is unfair and contrary to the rule of law. These common objections are rooted in misconceptions about the nature of law. When we distinguish more clearly between the sources of law, whether in statute or precedent, and the corpus juris, shaped by general principles of justice, the declaratory theory is (...) vindicated. Structured by familiar precedents and principles, the common law offers a framework within which the rule of law is sustained by moral reflection and argument. There is a close analogy with Rawlsian reflective equilibrium. It is only in virtue of an inquiry into justice, guided but not irrevocably bound by past practice, that there is any law to be declared. Legal judgment is precisely a determination of the requirements of justice as they apply in all the circumstances. (shrink)

Testimony, even in the well-worked parts of antiquity, continues to accrue, some from new papyri, some from texts long known but overlooked. In the result the critic is discomfited, honest men come by their own. οιόνδ' πέβη τόδε πργμα. This document, which consists of two lives of Homer and the Agon inserted between them, has long been derived from the Μουσεîον of Alcidamas. The conjecture was contested and the survival of Alcidamas denied. The publication of twenty-five lines from a papyrus (...) of s. II.–III. p. C. by Professor J. G. Winter , containing a Homeric biography signed αλκι] δαμαντος περι ομηρου put an end to the matter. See on the whole question Mr. Winter's remarks and a paper by Sig. The least attentive Hellenist must have noticed that the Greek tongue contains a number of pairs of nouns of identical or nearly related meaning—one in the masculine, the other in the feminine. The subject attracted the notice of Lobeck, Pathoiogia, pp. 7 sq., Technologia, pp. 267 sq.; G. Meyer in Curtius' Studien V., p. 68; Stein in the introduction to his Herodotus, p. lx ; and the resultant list will be found in Kuhner-Blass I., pp. 501, 502. It is not (...) complete , and the question deserves investigation. The only doctrine that can be called such appears to be the remark in schol. BT on Σ 551 , δρεπανας] Iωνκως, οủτο αρ τρεπουσ πάντα είς τφρη, ταρη αστρααλη. (shrink)
